Terms of Service

By accessing or using Tomo at withtomo.app (the "Service"), you agree to these Terms of Service. If you do not agree, please do not use the Service. These Terms apply to all users of the Service.

Tomo Labs Inc. ("Tomo") provides subscription-based retail buying software for independent fashion retailers and boutique buyers. The Service helps you plan budgets, manage buy plans, track purchases, and organize seasonal buying workflows. Features may change over time as we improve the product.

To use the Service, you must create an account and provide accurate, current information. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Please notify us promptly if you believe your account has been compromised.

Tomo may offer monthly and/or annual subscriptions. Payments are processed by Stripe. Tomo does not store full credit card numbers on our servers.

Subscriptions may renew automatically unless cancelled before renewal. You are responsible for managing or cancelling your subscription before renewal if you do not wish to continue. Unpaid fees may result in suspension or loss of access to the Service.

Tomo may offer a free trial. Trial terms may vary by plan or promotion. Where applicable, access may convert to a paid subscription unless you cancel before the trial ends.

You may cancel your subscription at any time. Cancellation stops future renewals. Access may continue until the end of your current billing period unless otherwise stated at checkout or in your account settings.

You retain ownership of the data you upload or submit to the Service. By using Tomo, you grant Tomo a limited license to host, process, and use your data only to provide, maintain, secure, support, and improve the Service.

You agree not to:

• Use the Service for any unlawful purpose or in violation of applicable regulations
• Attempt to gain unauthorized access to any part of the Service
• Transmit harmful, offensive, or disruptive content through the Service
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated means to access the Service without our express permission

The Service and its original content, features, and functionality are owned by Tomo Labs Inc. and are protected by applicable copyright, trademark, and other intellectual property laws. These Terms do not grant you any rights to Tomo's branding, software, or proprietary materials except as needed to use the Service.

We may update, modify, or discontinue parts of the Service from time to time. We may also update these Terms by posting a revised version on withtomo.app and updating the effective date. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

Tomo may occasionally offer experimental, preview, or beta features. These features may change, be discontinued, or contain errors, and are provided without additional warranties.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

To the maximum extent permitted by law, Tomo Labs Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.

We may suspend or terminate your account and access to the Service if you violate these Terms, if required by law, or if necessary to protect the Service or other users. You may stop using the Service at any time.

These Terms are governed by the laws of Ontario, Canada, without regard to conflict of law principles.
